Sumario:The objective of this research was to focus on the analysis and evaluation of processes that guarantee the Protection Action hearings conducted through telematics means. This approach critically examines the application of technology in the judicial sphere, specifically in the holding of hearings at a distance, and seeks to understand the extent to which these practices respect and guarantee fundamental principles of due process. The study delves into crucial aspects that go beyond mere technical feasibility, exploring the ethical and legal dimensions of telematics hearings. The basic due process guarantees of the judicial process are analyzed in detail, considering the possible interaction between technology and the fundamental rights of the participants. In addition, relevant legal regulations are examined to assess the congruence and adequacy of these practices with existing legal frameworks. An essential component of the research is the identification of possible vulnerabilities or challenges in the implementation of telematics hearings, seeking to better understand the practical and ethical implications of this emerging approach. The research is not only limited to the identification of potential problems but also proposes concrete recommendations and strategies to strengthen due process guarantees in the specific framework of protection actions. Ultimately, this study makes a significant contribution to the academic and legal debate on the evolution of judicial practices in the digital age. It seeks to provide a critical and reflective basis for the development of guidelines and policies that not only ensure efficiency in the administration of justice but also preserve and promote fairness and respect for fundamental rights in the context of Protection Action hearings via telematics.
