| Sumario: | The direct procedure appears from the entry into force of the Comprehensive Criminal Organic Code (2014) as an innovative method of discharging the Ecuadorian criminal system, specifically the Courts of Justice of the Country, its famous indication of single hearing of direct procedure is not consistent to the obligations enshrined in the Constitution of Ecuador regarding the guarantee of the right to defense of the accused for the crime of theft. The defendant is the turning point of this work because it is the weak procedural subject of the process with respect to the direct procedure, the defense of this is reduced with respect to the terms provided in the Organic Comprehensive Criminal Code (2021) with respect to its article 640 numerals 4 and 5. The maximum term of 20 days for the trial hearing in direct proceedings after the hearing on the qualification of flagrancy and legality of the arrest and the announcement of the evidence 3 days before it limits the right to defense of the processed. The study was carried out under a qualitative approach and a type of descriptive and documentary study, an interview guide composed of open and semi-closed questions was applied. |
