| Sumario: | ABSTRACT: Currently, Art. 387.3 of Código Orgánico Integral Penal determines that a fine of fifty percent of a basic salary and a reduction of nine points of the driver's license will be imposed on adolescent over sixteen years of age, who has a driving license, who requires the company of an adult or who has a license. According to Art, this provision may violate the rights of children and adolescents. 175 of the Constitution of the Republic of Ecuador should be subject to legislation and administration of specialized justice. In this sense, the present research aims to determine how Art. 387.3 of Código Orgánico Integral Penal affects the administration of specialized justice for children and adolescents. Due to the nature of the study, it was developed from a qualitative-quantitative approach with a descriptive scope and a non-experimental-transversal design. Through the study of documentation and reports related to specialized justice and after the analysis of the results obtained through the application of a survey to a sample of 97 legal professionals, it was possible to determine the unconstitutionality of Art.387.3 of Código Orgánico Integral Penal, which violates the principle that a specialized justice system should treat the legal conflicts of children and adolescents.
