The methodology used is dogmatic and comparative, with the purpose of critiquing the migratory phenomenon. Among the main findings, various solutions are proposed from a legal perspective to address the current issues.Esta investigación tiene como objetivo analizar la crisis humanitaria en el tapón del Darién, enfocándose en la invisibilidad social y la exclusión que enfrentan miles de migrantes que atraviesan esta selva en su camino hacia los Estados Unidos. Se empleó la técnica de análisis documental y se seleccionaron los principales textos relacionados con los Derechos Humanos y el Derecho Internacional relacionados con el objeto de estudio. La metodología utilizada es dogmática y comparativa, con el propósito de realizar una crítica al fenómeno migratorio. Entre los principales resultados se proponen diversas soluciones desde una perspectiva jurídica para abordar la problemática actual.Esta pesquisa tem como objetivo analisar a crise humanitária no Tapón del Darién, focando-se na invisibilidade social e exclusão enfrentadas por milhares de migrantes que atravessam essa selva em seu caminho para os Estados Unidos. Utilizou-se a técnica de análise documental e foram selecionados os principais textos relacionados aos Direitos Humanos e ao Direito Internacional que se relacionam com o objeto de estudo. A metodologia utilizada é dogmática e comparativa, com o propósito de realizar uma crítica ao fenômeno migratório.
