In fact, the Code of Criminal Procedure contains elements of crimes that we could qualify as Restorative Justice, such as suspension of proof proceeding, conciliation and full repair of damage. I will also present a brief analysis of the Bill of the Spanish Code of Procedure that is currently under discussion in Spain because it contains some elements related to Restorative Justice, such as proceeding suspension and mediation. Finally, I will provide a comparative analysis of our Code of Criminal Procedure and the Bill of the Spanish Code of Procedure with regard to the concepts of Restorative Justice and the rights of victims and offenders. I hope the essay will provide the reader with important knowledge about Restorative Justice.Con el presente trabajo, pretendo, hacer un análisis, del concepto “Justicia Restaurativa” y como dicho concepto ha recobrado interés y aplicación en la últimas décadas en nuestro país, tanto así, que nuestro Código Procesal Penal acoge varias figuras que podríamos calificar de Justicia Restaurativa, tales como la suspensión del proceso a prueba, la conciliación y la reparación integral del daño. Me interesa además hacer un breve análisis del proyecto del Código Procesal Español que actualmente se está discutiendo en España y que contiene algunas figuras también que tienen que ver con la Justicia Restaurativa tales como la suspensión del proceso y la mediación. Realizare además, para terminar, un análisis comparativo entre nuestro Código Procesal penal y el Proyecto del Código Procesal Español en lo que concierne a las figuras de Justicia Restaurativa y los derechos de la Victima y del Ofensor.
