| Sumario: | The discussion that will be addressed in this dissertation is focused on the analysis of the legality of affirmative actions for hiring employees by private companies, in light of the principles of equality, non-discrimination and human dignity, as well as in light of the guarantees of free initiative and the directive power of the employer, regardless of affirmative actions initiated by employers or state affirmative actions, provided that they generate obligations for private companies. Statistics on diversity in large companies will be brought to light, as well as the affirmative actions that they have been practicing, as well as to analyze federal laws and decrees that impose affirmative actions on companies. Furthermore, the main case law of the Brazilian Supreme Court will be analyzed regarding the legality and necessity of affirmative actions, in order to corroborate the principle-based analysis that unequal legal treatment is justified by the need to grant two entities material equality. Finally, we will verify possible practical effects of affirmative actions in private companies in institutes of Brazilian Labor Law |
