Sumario:This article exposes the failure of deprivation of liberty and its ineffectiveness in terms of its object of resocialization in the Brazilian prison system, listing some possible solutions to the current prison crisis. Furthermore, to show that prisoner resocialization is a pillar of Criminal Law, so that inmates can be reintegrated into society in a dignified manner, in order to offer opportunities for a fresh start away from crimes and, thus, leave the penal system of only one time. However, it will be shown that this option is currently often ineffective, due to the precariousness of the prison system and, also, the inapplicability of Law 7,210, which, combined with the lack of investment by the competent bodies, makes society itself not believe in the true meaning of prison, which is the resocialization.
