| Sumario: | The 2012 Forest Code established several changes in the national legislation. The creation of the CAR (Cadastro Ambiental Rural) and the institution of its competence to register the legal reserve were some of these innovations. With the registration of the legal reserve area in the CAR, its registration with the corresponding registration in the competent real estate office became an optional measure. Thus, this work seeks to analyze, through the deductive method and using bibliographic and jurisprudential research, whether such legislative innovation presents itself as a healthy measure capable of meeting the various desires and guarantees inherent to the right to property or whether, on the contrary, an incoherent normative setback in disharmony with the public records. Finally, it concludes for the diversity of functions of both registers, in the sense that each of them lends itself to a different relevant purpose. In this sense, the validity and maintenance of both records is convenient and appropriate. |
