Based on the perspective of Critical Criminology, bibliographic, documentary and descriptive research was carried out, in order to problematize the limits of criminal law, bourgeois democracy and politics itself. Taking into account the analysis carried out, the results point that the pandemic reinforces the crisis that already exists in the Brazilian prison system, indicating the urgent need to establish a criminal law of and for the subordinate classes, since the current framework serves as a mechanism that accentuates the exclusion, the oppression and extermination of a certain class and race within capitalist society.
