| Sumario: | Il testo sviluppa una analisi della specifica ed articolata disciplina generale delle c.d. “circostanze aggravanti ed attenuanti del reato”, che è ancora oggi prevista in Italia dal codice penale del 1930. La materia è da sempre oggetto di un controverso inquadramento, sia dogmatico, che funzionale, e presenta molteplici profili di criticità. Procedendo da una rinnovata verifica storico-comparatistica dell’attuale disciplina italiana, lo studio prende in esame le più recenti proposte di eliminazione della categoria e conclude fissando le basi per una “rilettura” del sistema italiano delle circostanze anche nella prospettiva di un’eventuale riforma del codice penale. Critics and perspectives of a reform Abstract The text develops an analysis of the specific and articulated general regulation of the so-called “aggravating and mitigating circumstances of the crime”, which is still provided for in Italy today by the Criminal Code of 1930. The subject has always been the subject of a controversial framing, both dogmatic and functional, and presents multiple critical profiles. Proceeding from a renewed historical-comparative review of the current Italian discipline, the study examines the most recent proposals for the elimination of the category and concludes by setting the basis for a “rereading” of the Italian system of circumstances also in the perspective of a possible reform of the penal code.
