Descrição
Resumo:This article debates the theoretical feasibility of the concept of iliberal constitutionalism. Going beyond the question of if it is only an oxymoron, it is demonstrated that, when claiming an approach that is both normative and empirical, it is not only possible, but necessary, to classify political regimes that are situated between democracy and puro authoritarianism as regimes of iliberal constitutionalism. Through bibliographic, comparative and illiberal concrete politics investigations, the article emphasizes that the main feature of iliberal constitutionalism is the subversion of liberal legal institutions against themselves and on behalf of specific political aims.
