Com o presente artigo, pretende-se analisar se nessa disputa de forma de construção constitucional havia também um enfrentamento sobre a passagem do tempo e seu controle. Será realizada uma investigação teórica sobre o processo histórico da construção constitucional de 1987 e do uso das formulações críticas sobre a relação entre direito e política na categoria do poder constituinte.Palavras-chave: Poder constituinte; Processo Constituinte de 1987; Poder constituinte e Temporalidade. AbstractThe congressional form of the constituent of 1987 was not a consensus among the oppositionists of the dying regime and the pro-regime. This paper tries to analyze if in this dispute of form of constitutional construction there was also a confrontation on the passage of time and its control. A theoretical research will be carried out on the historical process of the constitutional construction of 1987 and the use of critical formulations on a relation between law and politics in the category of constituent power.Keyword: Constituent power; Constituent Process of 1987; Constituent power and temporality. |
