Sumario:This article works with the theme of the Brazilian Federal State, from the perspective of the administrative control of the Judiciary by the National Council of Justice, and whether this experience can be reproduced at the state level. The approach is critical and does not disregard the influence of patrimonialism and class struggle in the composition, performance and culture of state bodies. To contextualize this scenario, authors such as Florestan Fernandes and Darcy Ribeiro will be used. Thus, there will be an exposition of the Brazilian Federal State, the CNJ and the arguments involving the institution of state councils of justice within the democratic and federalist aspects. The method used is deductive, which starts from a generalization for a particular question. The research technique used is the bibliography, which is developed from primary and secondary sources, that is, from the Constitution of the Federative Republic of Brazil of 1988, the jurisprudence of the Federal Supreme Court and scattered norms of the Brazilian legal system, as well as the available literature on the issue.
