Sumario:In 1989 the Washington Consensus summarized global economic policies that have been governing the global economy since the 1970’s that persevere to this day, to a greater or a lesser extent, in developing countries. This establishment is incompatible with the foundations, ends and objectives of the democratic rule of law and the contemporary constitutionalism. Contradicting democratic constitutionalism, the State is governed according to the logic of “socialization of risks and privatization of rewards”. Legal control of the economy is advocated so that the State starts to operate according to a logic of proportional distribution of risks and benefits and social inclusion, replacing the quest to economic growth exclusively, in order to effectuate the constitutional dispositions, in the Brazilian case, as well as the right of peoples and citizens to development, globally.
