Perhaps the author gives us the best clue when he writes that the choice of the analytical theory of law came before the option of natural law. Choose which placed partly in the tradition of his mentor Herbert L. A. Hart, who recognizes the invaluable contributions to the conceptualization of law, especially the descriptive power of analytic theory. Thus, like Hart, Finnis took hard linguistic accuracy and the intrinsic difficulties of the analytical tradition.A intenção do artigo não é tanto retomar as teses de direito natural contidas na obra de Finnis, embora a todo momento elas estejam presentes, mas unicamente apresentar em linhas gerais a escolha metodológica do autor. Qual foi a pretensão metodológica de John Finnis ao escrever e publicar Natural Law and Natural Rights? Talvez o próprio autor nos ofereça a melhor pista ao escrever que a escolha da teoria analítica do direito veio antes da opção do jusnaturalismo. Escolha que o colocou em parte na tradição de seu mestre eorientador Herbert L. A. Hart, a quem reconhece inestimáveis contribuições à conceituação do direito, principalmente pelo poder descritivo da teoria analítica.
