Sumario:The object of workpaper is to verify, from the Convention on the Rights of the Child, the possibility of reinterpretation of the support of the aid reclusion in favor of dependents of insured not bearing the condition of "low income", economic requirement limiter the granting of the benefit, established by Constitutional Amendment number 20. The matter was considered by the STF, but didnt examine the issue from the perspective of the Convention on the Rights of the Child. We concluded that the analysis should be carried out from the economic conditions of the child, being possible to recognize that the benefit of aid-reclusion is due at least to dependent up to 18 years, whose gross income monthly does not exceed R$ 1.089,72 (updated by Portaria Interministerial MPS/MF nº 13, of 01.09.2015).
