Sumario:The discussion about what constitutes secularism has gained space in Brazilian daily life due to the heated and growing debate about the boundaries between religion, law and politics. The topic permeates electoral agendas, government promises and legal proceedings, which reflect not only one, but the most varied conceptions of secularism. The deep relations between the State and Religion are the result of a historical-social construction since Portuguese colonization. Religion has always been present in official documents and in daily life in Brazil. In view of this, this work aims to investigate the religious imaginary contained in the preamble of the Brazilian Federal Constitution of 1988 as the result of a cultural process and its influence on the conceptions of secularism that are currently presented. Based on the study of the imaginaries (religious and legal), we sought to understand what religious values ​​​​are contained in the introductory document to the constitution and how they influenced the construction of Brazilian secularism. In order to pursue the objective of the investigation, bibliographical research was used, with a focus on reading books and scientific articles. The article is divided into three subsections: 1) imaginary, religion and law: (re)thinking the (in)congruities; 2) the preamble of the Brazilian Constitution and its religious content; and 3) the religious imaginary and Brazilian secularism: a utopia? In the end, it will be seen that the analysis of the notion of secularism must be carried out in a contextualized manner in time and space, considering the religious imaginary arising from the sociopolitical context and the various historical processes verified.
