Sumario:This thesis is dedicated to examining, in the juridical and anthropological field, the scission in the State's Ethical Order caused by the conflict between the family, that represents Natural Law as religious values, moral values and bonds of affection, that is, as subjectivity, and the State, that represents Positive Law. In this sense, the central objective of this research is to propose an approach that reconciles these two spheres while maintaining their respective singularities, so that it is possible to realize the idea of Justice as subjective freedom in the Brazilian context. In essence, its objectives are to analyze the scission in the State's Ethical Order caused by the conflict between Positive Law and Natural Law, propose a reconciliatory approach to these ethical spheres based on Niels Bohr's Dialectic of Complementarity and examine the philosophical and legal implications of this reconciliation for Justice in the Brazilian context. The main theoretical bases used were the Philosophy of Law and Niels Bohr's Dialectic of Complementarity. This research adopts an interdisciplinary approach that combines philosophical and anthropological analysis, case studies and extensive literature review. Cases of complex ethical conflicts and legal dilemmas are examined to demonstrate the application of the Dialectic of Complementarity in the reconciliation of Positive Law and Natural Law. This approach proved to be promising in reconciling Positive Law and Natural Law, allowing the harmonious coexistence of these ethical spheres and offering a new perspective for the search for Justice as subjective freedom in the Brazilian context, thus contributing to the restoration of the Ethical Order of State.
