Sumario:The current article seeks to verify whether Hans Kelsen, in the second German edition of the Pure Theory of Law, in the light of the periodization proposed by Stanley L. Paulson, has abandoned the (neo)Kantian project in favor of realist theories. For this purpose, within the structure of the legal and the fundamental norm, the dialectical-comparative method between the first German edition of the Pure Theory of Law, published in 1934, and the second German edition of the Pure Theory of Law, published in 1960 is used to analyze the permanence of the (neo)kantian project in the writings of Hans Kelsen. At the end, conclusions and brief considerations on this research are presented, especially regarding the philosophical divergence between permanence and mutability in the Pure Theory of Law.
