| Sumario: | This current paper is dedicated to the non-civil administrative’s prosecution improbity. The text initially presents main considerations on the administrative probity protection, remarkably through the application of sanctions to unethical agents. Afterwards, it analyses the aspects of administrative’s prosecution improbity action that most directly concern the non-civil prosecution agreement. Subsequently, the study approaches the coexistence of various mechanisms to solve interest conflicts focusing on consensual solutions concerning the Public Treasury, stepping into the consensuality in the scope of Administrative Law and, particularly, in the administrative’s improbity field. Finally and specially, it seeks to approach the main points about the non-civil prosecution agreement, which has been perceived in the Law 8.429/1992, after the changes promoted by the Law 13.964, of december 24th, 2019, currently ruled by the new 17- B article, included in the Administrative Improbity Law 14.230/2021 |
