Resumo:The work addresses the themes of freedom to teach (academic and institutional) and university autonomy, both for public and private IES. It is noted that this topic has gained importance in Brazil since the promulgation of the Federal Constitution of 1988. This constitution establishes education as a concrete fundamental right and includes university autonomy and academic and institutional freedoms to teach. The text seeks to reflect on the existing tensions, regarding autonomy and teaching freedoms, between public authorities and IES. It shows, through exemplary cases, that the centrality of these impasses related to autonomy and freedoms are, initially, related to the interpretation of legislation, but they also concern the political context in which they occur. The article also exposes the dichotomy that exists when comparing the degrees of autonomy and teaching freedoms between public and private IES. The research carried out is bibliographical (based on authors who discuss this topic) and documentary (centered on constitutional and infra-constitutional norms that deal with the topic and on decisions of the STF).
