Resumo:This article addresses the current understanding of insignificance principle in the Brazilian legal order. To this end, the subject will be reviewed from the theory of juridical good from Fuerbach and Birnbaum, analyzing the offense and the material content of the crime. After the intro we will study insignificance principle as thought by Claus Roxin. Finally, we will present the principled interpretation of insignificance by Brazilian doctrine and the consequences of this treatment affecting the case law of the country. For this, it will be qualitatively demonstrated decisive interpretations of the Supreme Court that aim to remove the criteria of injury by subjective or moral and abstract parameters, critically ending the approach on the subject.
