| Resumo: | This article analyzed the changes proposed by Provision n. 141/2023, edited by the Brazilian National Council of Justice, referring to the institute of the Common-Law Marriage (“Stable Union”) and the innovations in Brazilian Registry Law. The aforementioned regulation contains clarifications regarding the procedures for preparing “Declaratory Terms and Dissolutions of Common-law Marriages”, as well as the new Electronic Certificate to prove the length of time they have cohabitated, instruments capable of producing the necessary effects if implemented within the scope of the Registration Offices of Natural Persons in the country. Furthermore, it approached, in a critical way, the viability of implementing modifications in the property ruling regime of those relationships, a controversial issue proposed in comparison to the statutory requirements placed on modifications made in marriage property system. Finally, a dialogue was woven on aspects of competence, validity and effectiveness of the aforementioned out-of-court instruments, the valuation of out-of-court services in the country and the possible paths of projection in this family unit. |
