Resumo:The purpose of this article is to analyze false memories, their formation, and the aspect in which they affect the Brazilian criminal process. To do so, the methodology applied to perform such analysis consists of using the transdisciplinary hermeneutic method. As the subject of study, information was gathered based on bibliographic reviews. Through research, it was found necessary for the Judiciary to adapt to new techniques and tools to ensure clarity and veracity of the truth in testimonies. Using memory during witness testimonies leaves gaps susceptible to errors and distortions due to the lapse of time, circumstances, and the creation of false memories.
