Resumo:In this article, in the field of Philosophy of Law, taking in account the method of immanent analysis, elaborated in Brazil by José Chasin, fallowing György Lukács, we intend to analyze Marx and Engels´ treatment of the matter of Justice. The objective of this article is to analyze the texts of the authors mentioned and to prove that: Justice, as well as Law itself, is criticized by the German authors and, because of that, it is impossible, in their work, to see Justice as something that can be opposed to Law. As a result, the authors think that the matter of Justice would, in fact, hide the central flaws of capitalism itself: the authors of the Communist Manifesto, actually, say in their work that the idea of Justice, in the XIX century, presupposes a given mode of production. As a conclusion, it would be impossible to search to any kind – even a critical one – of “eternal Justice” or “Justice in transactions”.
