Summary:This article deals with the legislation of the State of Paraná on Special Education, seeking to make historical and political correlations that help to understand the choice of this Brazilian state to go against Inclusive Education, which has been provided for since the Brazilian Federal Constitution (1988) and which is ratified by the Convention on the Rights of Persons with Disabilities (2009) and the Brazilian Law for the Inclusion of Persons with Disabilities (2015). Decree 10.502/2020, was suspended by the Federal Supreme Court and later revoked by the next government, has many similarities with the option adopted by the state of Paraná, which has been strengthening the segregated and private option as a special education policy for people with disabilities since the PNEEPEI was approved.
