Sumario:This article conducts a qualitative analysis of 36 decisions of declassification or acquittal in cases involving behaviors criminalized by Law 11.343/2006 (Drug Law) published by the São Paulo State Court of Justice in the years 2010, 2011, and 2017. The aim is to comprehend how police narratives are handled in cases where such testimonies do not appear to be central to the decision. When examining the outcomes within the Brazilian criminal justice system, the literature points to the predominance of convictions based on police testimonies. However, some cases do not result in such outcomes, leading to sentences or declassification of the offense to "possession for personal use" or even acquittal, which initially contradicts the police narrative. In this regard, the investigation reflects on the main types of arguments found in such cases and the existing possibilities of potential "escape routes" from the predominant judicial approach.
