description This article analyzes the right to image in the face of new challenges posed by technological development and artificial intelligence, focusing on the phenomenon of deepfakes. In this way, we sought to understand how this new technology occurs and what impacts it can have on the right to image of individuals within cyberspace. There was a discussion about the forms of protection and prevention found in Brazilian legislation to face the problem today. The methodology used in the research has a bibliographic and exploratory nature, in doctrines, legal articles from specialized magazines on the subject and in current legislation and draft laws. The research recognized that the Marco Civil da Internet (Law No. 12,965/2014), legislation highlighted on the topic, is not effective in relation to holding internet connection providers responsible for the damages generated by deepfakes in the virtual environment, in addition to that the aforementioned The law is non-specific to promote punishment for abuses generated by this new technology. Despite this, the Electoral Code and the Brazilian Penal Code already make progress when it comes to protecting individuals against deepfakes. What can be observed is that there is an international effort to create recommendations and avoid harm caused by artificial intelligence and, in Brazil, there are already bills with the same purpose. Finally, it was concluded that digital and media education and the continuous advances in legislation on artificial intelligence and deepfakes must be seen as the protagonists in tackling the problem.

De esta manera, se buscó comprender cómo ocurre esta nueva tecnología y qué impactos puede tener en el derecho a la imagen de los individuos dentro del ciberespacio. Se discutió sobre las formas de protección y prevención encontradas en la legislación brasileña para enfrentar el problema hoy en día. La metodología utilizada en la investigación tiene un carácter bibliográfico y exploratorio, en doctrinas, artículos legales de revistas especializadas sobre el tema y en legislación y proyectos de ley actuales. La investigación reconoció que el Marco Civil da Internet (Ley Nº 12.965/2014), legislación destacada sobre el tema, no es efectiva en relación con responsabilizar a los proveedores de conexión a internet por los daños generados por los deepfakes en el entorno virtual, además de que dicha ley no es específica para promover el castigo por abusos generados por esta nueva tecnología. A pesar de esto, el Código Electoral y el Código Penal Brasileño ya avanzan en la protección de los individuos contra los deepfakes. Lo que se puede observar es que hay un esfuerzo internacional para crear recomendaciones y evitar el daño causado por la inteligencia artificial y, en Brasil, ya hay proyectos de ley con el mismo propósito. Se concluyó que la educación digital y mediática, junto con los avances legislativos sobre el tema, deben liderar la lucha contra el problema.O presente artigo analisa o direito à imagem frente aos novos desafios propostos pelo desenvolvimento tecnológico e pela inteligência artificial, com enfoque no fenômeno das deepfakes. Desse modo, buscou-se compreender como se dá a ocorrência dessa nova tecnologia e quais são os impactos que ela pode causar no direito à imagem dos indivíduos dentro do ciberespaço. Discutiu-se acerca das formas de proteção e prevenção encontradas na legislação brasileira para enfrentar o problema atualmente. A metodologia utilizada na pesquisa tem natureza bibliográfica e exploratória, em doutrinas, artigos jurídicos de revistas especializadas na matéria e em legislações e projetos de leis vigentes. A pesquisa reconheceu que o Marco Civil da Internet (Lei nº 12.965/2014), legislação em destaque no tema, não é efetivo com relação à responsabilização dos provedores de conexão à internet pelos danos gerados pelas deepfakes no ambiente virtual, além de que a referida lei é inespecífica para promover a punição destes quanto aos abusos gerados por essa nova tecnologia. Apesar disso, o Código Eleitoral e o Código Penal brasileiro já possuem avanços no que se refere à proteção dos indivíduos contra as deepfakes. O que se observa é que há um esforço internacional para criar recomendações e evitar prejuízos causados pela inteligência artificial e, no Brasil, já existem projetos de lei com a mesma finalidade.
