Yuval Noah Harari further explains that sapiens have the competence to cooperate in pursuit of common goals and not just for fun or playfulness. Alain Supiot, in Homo ju- ridicus, explains the influence of the "founding beliefs" of law. Like Huizinda's ludens, Supiot's homo juridicus creates a parallel environment, in addition to physical relations, to justify and establish their social relations. The implementation of alternative and pea- ceful forms for the solution of controversies is highlighted in all branches of the legal sciences, deserving prominence in constitutional law. No one better than the stakehol-ders to decide how to resolve their conflicts. The progressive implementation of conflict resolution methods based on self-composition ultimately leads to a stimulus to demo- cracy, through greater participation of stakeholders in the decision-making process of their own problems.

Johan Huizinga, em Homo Ludens publicado em 1938, desenvolve de forma profunda um estudo que relaciona o comportamento humano ao lúdico. Yuval Noah Harari explica ainda que o sapiens tem competência para cooperar com vistas í  obtenção de objetivos comuns e não apenas para a diversão ou o lúdico. Alain Supiot, em Homo juridicus, explica a in- fluência das "crenças fundadoras" do direito. Assim como o ludens de Huizinda, o ho- mo juridicus de Supiot cria um ambiente paralelo, além das relações fí­sicas, para justifi- car e estabelecer suas relações sociais. A implementação de formas alternativas e pací­fi- cas para solução de controvérsias tem destaque em todos os ramos das ciências jurí­dica, merecendo grande destaque no direito constitucional.
