| Sumario: | The subject under analysis concerns about the concept of dangerousness and it´s sufficiency as a legal foundation of security measures in Brazil, aiming, more specifically, to analyze and to systematize the main aspects that concerns about the conceptual insertion in the penal system, examining the object from three axes: dogmatic, critical and systemic. This paper explores whether the concept of dangerousness is sufficient and consistent with the current development of criminal justice system. To do so, is analyzed, first place, the development of culpability concept in dogmatic, aiming to clarify the main aspects about the theme, enabling to examinate the compatibility between dangerousness and culpability on penal system. Besides that, this research intents to analyze the concept of dangerousness in a dogmatic and systemic aspects, in order to support the critique about concept sufficiency. Finally, it was concluded that the concept of dangerousness, as a legal foundation, is insufficient and outdated in view of the current Brazilian legal system. |
