Sumario:The central objective of this study is to analyze the importance of the Proposed Constitutional Amendment (PEC 512/2010) for the protection of the rights of children and adolescents in international custody disputes. This proposal seeks to transfer jurisdiction from federal courts—currently in place because Brazil is a signatory to the Convention on the Civil Aspects of International Child Abduction—to state courts, aiming to prioritize the best interests of minors.
