Descrição
Resumo:This article analyzes the exposure of images and personal data of children and adolescents in digital environments, made by parents, as well as the risks associated with this practice, the legal implications arising from it, and the mechanisms conferred by law for its proper confrontation. The research problem is to question: what is the limit of parents’ autonomy in disclosing information and images of their children on social networks, in the exercise of parental authority, without violating the fundamental rights of these children and adolescents? The research concludes that despite there being no delimitation on what exposure characterizes or not the practice of sharenting, it is certain that the phenomenon has the potential to cause violations to the personality rights of children and adolescents, mainly to privacy, image and personal data, and can, considering the various consequences that fall on the children, be seen as an abuse in the exercise of parental authority, therefore, reverberating in the legal sphere of parents and children. The research used the deductive approach method, using bibliographic survey and documentary analysis. Relevant information sources were chosen, including academic databases, institutional repositories, government websites, and virtual libraries. The focus was on academic works, legislation, jurisprudence, and bill projects, as a means of analyzing the theme.
