Sumario:The purpose of this article is to analyze the consumer protection in the context of the so-called arbitration clauses referred to in article 16, penultimate and final clauses of Law 19.496 and the rules of the Chilean Organic Code of Courts (Código Orgánico de Tribunales). The purpose is to establish the special arbitration tutelage, on the one hand, and the effect of the source of arbitration on the other, that formally meet the requirements of the rules on this matter. In order to do so, some explanations are provided on the historical background considered by the drafters of the aforementioned rule, and the regulation that deals with the rights arising therefrom is analyzed. The results of the investigation show that the Chilean solution leads to guaranteeing the so-called arbitration jurisdiction through two rights that share the purpose of preserving the effect recognized by the norm.
