Sumario:The problem addressed is the conflict between the fundamental right of privacy which opposes the constitutional requirement of publicity of notarial acts in case of extrajudicial divorce public deeds. The aim is to examine the dogma of the fundamental right to privacy in face of notarial publicity requirement of extrajudicial divorce. The procedure is a theoretical research, qualitative, with documentary and bibliographical research. It is used the dialectical method proposed by Krohling to analyze the presented oppositions (privacy x publicity). The theoretical framework is subsidized in the privacy of Rodotà and Fundamental Rights Theory of Alexy.
