| Sumario: | The objective of studying the case of the Action of Non-Compliance with a Fundamental Precept (ADPF) number 635 was to treat the theme of police violence as public policy. If police operations were already an important issue and needed to be addressed by the Constitutional Court with the COVID-19 pandemic, its intervention became extremely necessary. The health measures indicated to cope with the pandemic included social distancing that resulted in less movement of people and, therefore, security agents felt more comfortable to commit abuses. It was verified in this investigation that security policy, in general, is the current tool of maintaining racism and inequalities, from the militarization of the daily life of black and poor people. The analysis of this study showed the basic role of racism to allow the State to implement biopower and, in view of the finding of constant human rights violations by the Brazilian State, the practice of necropolitics in the country was verified. |
