| Sumario: | This article aims to verify the evidence of the data presented in the seven corporate courts of the TJ / RJ, about the increase of recoveries and bankruptcies. The research had as its starting point the 20th of March 2020 and the eighty-five days that followed it. We sought to analyze the impacts that could bring two points of PL1397/ 2020, to creditors and the judiciary, if approved: the suspension of deadlines, legal and negotiation, and the expansion of competence in the preventive negotiation phase. It was found that there was no increase in the number of researched processes that would justify the approval of a PL 1397/2020. But the survey signaled the need for urgent administrative measures in order to give priority to the judicial reorganization process and to horizontalize the institute of extrajudicial mediation. |
