Sumario:This study bases itself on the assumption that “punitive damages” exist in the Brazilian legal system. For that reason, this paper investigates the objective and subjective requirements of punitive damages in the United States’ as a means for exploring its use in the Brazilian legal experience. Furthermore, this research examines the application of punitive damages in the United States and Brazil, seeking to identify problems in the Brazilian legal system. In conclusion, this body of work explores the use of damage prevention (primary function of punitive damages) and the objective and subjective requirements of “punitive damages” in Brazil.
