The reasons thatcause the use of arguments that justify the criteria of fairness and justice become indispensable if one intends to know the populationsegments that are devoid of the minimum consumption goods. Health is part of these goods, for excluded persons hardly ever have accessto it when necessary. Health, as one of the values that is part of human rights, cannot be separated from the other values such as life,freedom, autonomy and respect for the dignity of the person. Medicine offered to needy populations not always has the obligation ofbeing endowed with a greater technological wealth. This part of the population deserves more information, by means of a reasonableeducation, than the use of examinations or prescriptions of drugs. The structural problems that cause injustice must be equated anddeserve more attention from the State regarding the universalization of the access to health systems, when it is necessary. This distortionwill only be corrected by means of fairness and justice complemented by income distribution to the need populations.A Bioética tem como um desafio atual fundamentar a utilização ou não de uma medicina para as populações carentes. Asrazões que levam à utilização de argumentos justificadores dos critérios de eqüidade e justiça tornam-se indispensáveis ao se pretenderconhecer as parcelas da população situadas à margem dos bens mínimos de consumo. Cite-se a saúde no rol desses bens, pois os excluídosdificilmente conseguem alcançar o acesso quando dele precisa. A saúde, como um dos valores que integram os direitos humanos, nãopode ficar a margem dos demais valores, tais como, a vida, a liberdade, a autonomia e o respeito à dignidade da pessoa. Nem sempre amedicina oferecida às populações carentes tem a obrigatoriedade de ser dotada de maior riqueza tecnológica. Essa parcela da populaçãoestá por merecer mais informação, mediante educação accessível, do que propriamente a utilização de exames ou de prescrição. Osproblemas estruturais que ocasionam injustiça devem ser equacionados e merecer maior atenção do Estado quanto à universalizaçãoao acesso aos sistemas de saúde, quando necessário.
