| Sumario: | This article analyzes the concept of acquittal by clemency within the Jury Court system, focusing on the sovereignty of jury verdicts as provided in Article 5, section XXXVIII, of the 1988 Brazilian Federal Constitution. It assumes that the jury’s decision to acquit may be based on subjective criteria, including moral or value-based judgments, even when there is sufficient evidence for conviction. Using bibliographic research and jurisprudential analysis, the article explores doctrinal and judicial perspectives on the legitimacy of this type of acquittal, particularly when it diverges from purely technical foundations. The study shows that clemency constitutes an expression of the counter-majoritarian function of the Jury, exercised in defense of community values and substantive justice, despite its tension with principles such as the duty to state reasons and penal rationality. It concludes that acquittal by clemency is legally valid and constitutionally protected, provided it is delivered by the jury in accordance with due process guarantees. |
