| Sumario: | The present article aims to explain and propose a legal hermeneutics based on rhetoric. For this, in a first moment, hermeneutics is presented as one of the “constraints” of the dogmatically organized law. In a second moment, it is explained how it was understood by the legal positivism of the 19th century. And then, the understanding of Hans-Georg Gadamer and his philosophical hermeneutics is discussed. Finally, a rhetorical hermeneutics is proposed for the institutionalization of the public control of language. |
