Thus, the research finding, tracing profiles on the appropriate theoretical concepts of state and right of each model were compared the proposed access at the discretion of the space to the category of poverty in each. For this, the concepts covered in the proposals of the Welfare State Project Florence, and a state inserted in the context of globalization to the recommendations of the Bank. Thus, demonstrates that the type of access set out in Florence Project through its three waves addresses the concern about the effectiveness of social rights, and that the recommendations of the Bank are included in a speech proposing the opening of markets and a Judicial least. With that, search is the analysis of access to justice democracy, able to incorporate spaces for nonprivileged, without, however, play model of inequality.

With that, search is the analysis of access to justice democracy, able to incorporate spaces for nonprivileged, without, however, play model of inequality.O presente trabalho trata das concepções de acesso à justiça consideradas em dois grandes modelos: o Movimento pelo Acesso à Justiça expresso no Projeto Florença, na década de setenta, e o proveniente das recomendações do Banco Mundial para a reforma do setor judiciário na América Latina e Caribe, notadamente expressas no Documento 319S. Desta maneira, a pesquisa busca, traçando perfis teóricos cabíveis quanto às concepções de Estado e de direito em cada um dos modelos, analisar comparativamente as propostas de acesso, segundo o critério do espaço reservado à categoria de pobreza em cada qual. Para isto, são enquadradas as noções de Welfare State às propostas do Projeto Florença, bem como de um Estado inserido no contexto da globalização às recomendações do Banco, muitas vezes chamado de neoliberal. Assim, demonstra-se que o modelo de acesso exposto no Projeto Florença através de suas três ondas renovatórias trata da preocupação em relação à efetividade dos direitos sociais, e que as recomendações do Banco estão inseridas num discurso que propõe a abertura dos mercados e a construção de um Judiciário mínimo.
