Sumario:The key problem is the controversy generated during the judgement of the Complaint 4.335 - AC, which divided the votes of the ministers of the STF and provided, in constitutional law, the debate of issues such as constitutional mutation, the expansion of the effects in diffuse judicial review decisions and the Federal Senate. The research has as a theoretical goal to analyze the entire content of the Complaint No. 4.335 – AC, as well as the analysis of the writings jurists as Lenio Streck and Marcelo Cattoni. It was used to carry out this work a theoretical methodology and literature review.
