Sumario:Objective: Analyzing the difficulties of the state interventionist model in dealing with all the economic and social changes imposed by globalization, this study seeks to understand the phenomenon of governance as a neoliberal response to the demand for efficiency, effectiveness and economy. The objective is to critically analyze the legitimacy and effectiveness of this new panorama, in which the actions of various social actors, in competition with the State, acquire such significant proportions and strength as to characterize “governance without government”, for beyond the state apparatus. Methodology: Through normative-deductive methodology, using documentary and bibliographical research, the aim is to investigate the transition from the format, then predominant, of traditional state command and control mechanisms to the regime of private regulations. Results: Observing the internal and external erosion of the State due to a governance model that carries anti-democratic traits, this study will come across the need to develop legitimate proposals focusing on the format of regulated self-regulation. Contributions: The article, delving deeper into the side effects of globalization and technological advances, brings provocations about the new global organization, deconstructing, in a way, its emancipatory potential.
