Sumario:Th is article objective is to analyze selectivity’s refl ection in the complimentary protection of legal goods in the moment of the creation of the International Criminal Court. At fi rst, it investigated the functions of the ICC from the viewpoint of the functions performed by the nationals systems of criminal law. Th en, traces over the criminalization process ways, identifying the operational method of selectivity to, fi nally, check the consequences for protection of goods in the international criminalizing process. In this context, it evaluates the impact of the creation of the ICC in the protection of legal rights and observes that a permanent international criminal court exerts an important tutelage role.
