To this end, the general objective is to analyze the right not to produce evidence against oneself and what Bill n. 3.148/2021 of criminalizing perjury. As for the specific objectives, they will proceed on three grounds: describe the figure of perjury, analyze the principles and constitutional guarantees related to the defendant's right not to produce evidence against themselves and evaluate the constitutionality of Bill no. 3.148/2021 in light of the Federal Constitution. The research methodology adopted is classified as qualitative and descriptive, as it will study different understandings related to aspects intrinsic to the rights of the individual, through doctrines, jurisprudence, legislation and scientific articles. Finally, it was concluded that the legislative proposal is unconstitutional.Este artigo tem como objetivo estudar a criminalização da mentira do acusado sob o prisma do Projeto de Lei nº 3.148/2021, que tem como finalidade incluir a tipificação penal do perjúrio no ordenamento jurídico brasileiro. O estudo trará como problema de pesquisa a seguinte questão: o Projeto que objetiva incluir o perjúrio como tipificação penal é constitucional? Para tanto, tem-se como objetivo geral analisar o direito de não produção de provas contra si e o que pretende o Projeto de Lei n. 3.148/2021 de tipificar o perjúrio. Quanto aos objetivos específicos, transcorrerão em três fundamentos: descrever a figura do perjúrio, analisar os princípios e garantias constitucionais relacionadas ao direito do réu de não produzir provas contra si e avaliar a constitucionalidade do Projeto de Lei n. 3.148/2021 à luz da Constituição Federal. A metodologia de pesquisa adotada classifica-se em qualitativa e descritiva, pois estudará diversos entendimentos relacionados aos aspectos intrínsecos aos direitos do indivíduo, por meio de doutrinas, jurisprudência, legislação e artigos científicos.
