Sumario:In this article, there is an approach to the protection of personality rights to reputation and image, which, first, will be conceptualized and differentiated because they protect very close legal interests. After understanding the safeguarding of these rights, the issue of commercialization of existential interests and the possibility of not monetizing civil liability in cases of offense to personality rights will be addressed. The general objective is to seek to present a measure for a protection of the rights to honor and the image without commodifying them. The specific objectives consist of understanding the rights of the personality and the phenomenon of non-monetization of existing interests to addressing the possibility of off-balance sheet repairs. The hypothetical-deductive research method is used, starting from the analysis of the concepts to the approach of the means of guardianship, having a hypothesis to be proven, that is, verifying off-balance sheet reparation as a possibility of better fulfillment of the functions of civil liability. For that, the technique of bibliographical research will be used.
