Sumario:This article’s objectives are to understand the capitalism influences in the criminal practice, along the perspectives of Criminal Law and Penal System scholars. The study of the criminal practice in face of capitalism, justifies itself considering its several mechanisms of control, moreover, the different moments of social economic systems. The Criminal Law is used as the guarantor tool of the most important item for the capital market, the patrimony. In this way, the present article seeks to analyze if the sentence is directed connected to the maintenance of marginalization, and if this fact hinders the socialization of the convict, if the capitalism produces criminals, influence the overpopulation in prisons and the creation of its metropolis.
