Sumario:This article aims to analyze how the idea of the panopticon thought by Jeremy Bentham (2008) is present in today's society. The intention is to evaluate how the Brazilian legal system has protected the right to informative self-determination in the face of new forms of panoptism. For this, the hypothetical-deductive method and the bibliographical methodology were used, carried out by researching articles, books and legislation on the subject, collected from databases, especially EBSCOhost. At the end of the research, it was found that the protection and effectiveness of informative self-determination needs a specific treatment beyond the sphere of protection of the right to privacy and intimacy, from which it is concluded that it should be recognized as a right of personality.
