| Sumario: | Law No. 13.467/2017 profoundly modified the model of trade union costing in Brazil, causing weakening of trade union entities and leading them to seek new mechanisms to obtain contributions from members of the category. One of the “theses” that have emerged has been that trade unions will negotiate only for the benefit of associates or, in another case, only those who are discharged with contributions to the union. The latter part also gives way to the membership of the category, and contributes to the payment of union contributions. This doctrinal article rebates this thesis, because it is unconstitutional, discriminatory and politically disastrous, at the same time that it propitiates to more weakening and loss of the legitimacy of Brazilian trade unionism. |
