Sumario:In the current circumstances, in which unmeasured human actions are the main reason for the deterioration of the environment, the Kyoto Protocol, through measures such as the Clean Development Mechanism, proposes new prospects for the development of new projects and sustainable technologies. Based on the hypothetical-deductive method, this study presents an alternative as carbon credits, so that you can achieve the goals of reducing emissions of greenhouse gases, the specific object of this study are the Clean Development Mechanism (CDM) that can be used by developing countries. This paper aims to demonstrate that in Brazil, there is still uncertainty about the regulatory standards that establish the legal nature of such claims, which ultimately preventing the proper legal treatment under this kind of trade. Such indefinition is nocuous to the development of the Brazilian carbon market, considering that creates uncertainty for investors.
